Windsor Framework – Not for EU labelling UPDATE
NIRMS was introduced as part of the Windsor Framework agreement to simplify the movement of goods to NI.

Phase 2 of the scheme had attracted some controversy because it called for ALL applicable products to be labelled “Not for EU” when sent to the GB market (England, Scotland, Wales) as well as NI by 1 Oct 2024.

A consultation took place earlier this year, the result of which is yet to be published. Further delays have been caused by a change of government. DEFRA have issued an update to the guidance today (please find DEFRA announcement attached). 

Key changes:
Commodity Code Updates: A note that updates have been made to commodity codes for both Phase 1 and Phase 2. DEFRA advises the list is not exhaustive. You can find the commodity codes here: Link

Phase 2 dates for “Not for EU” labelling across GB: All references to the 1 Oct date for “Not for EU labelling” across UK have been removed throughout the document. Updated document can be found here: Link.

The first Common User Charge (CUC) invoices were issued earlier this week.

The CUC is a charge for Sanitary and Phytosanitary (SPS) imports via Dover or Eurotunnel, that are eligible for checks at Sevington Border Control Post (BCP) in Kent.

• how to set up payments 
• ways to pay the invoice; and  
• who to contact with invoice queries or payment issues

Other charges you need to pay
Where appropriate, APHA and Ashford Port Health will charge you for the following SPS checks:

• a document check – this is usually done before the goods arrive in Great Britain    
• an identity check 
• a physical check

These charges are separate to the common user charge and are based on type of consignment, risk level and weight.

Find out the SPS check charges for:   

• plant and plant products  
• animal products and high risk food and feed not of animal origin (HRFNAO)

For mixed load consignments of plants and plant products and products of animal origin (POAO), you will be charged for SPS checks for both categories.
